We provide excellent advice in various fields of Insolvency Litigation, and assist our clients in the following areas:

• Sequestration Applications, compulsory or voluntarily;
• Liquidations or Winding-Up of companies and closed corporations (CC’s) either defending or launching these proceedings;
• Completion lodging and proof of our client’s claims at meetings of creditors;
• Analysation and establishment of our client’s claims;
• Section 417 and 418 enquiries in terms of the Companies Act 71 of 2008;
• Business Rescue proceedings; and
• Rehabilitation proceedings of our clients after the requirements are met for rehabilitation therein.

LIQUIDATOR AND TRUSTEE SERVICES

SD Nel was enrolled on the Masters Panel’s List of Liquidators on 15 December 2023. The firm can therefore assist clients in taking up appointments as a liquidator in insolvent estates, and conduct duties either as a Liquidator, in the event of Liquidations, or as a Trustee in the event of Sequestration.

The Process of Liquidating the Estate, meetings with Creditors and Distributing of the Estate would thereafter follow in terms of the Companies Act 61 of 1973 or 71 of 2008 alternatively the Insolvency Act 24 of 1936.

BUSINESS RESCUE PRACTITIONER SERVICES

SD Nel is furthermore registered as a Junior Business Rescue Practitioner with the Companies and Intellectual Property Comission (CIPC) since September 2009 and the firm offer services as Business Rescue Practitioner for clients with a need for such services.
